1 .- Introduction. The following document is a contract between the client and Ygoo, S.A. We request you read it carefully. Upon accessing this website or using it in any way, you accept the obligations of the contract and agree that you have read and understand its conditions. Read the contract carefully as it contains information related to your legal rights and the limitation of those rights and the laws applicable to conflicts. If you do not accept the totality of the terms and conditions, you should not use this site nor reserve any products. Concerning all the reservations, it will be assumed that the person who makes the reservation has accepted this contract in name of the person named on the reservation.
2 .- Objective of the contract. Ygoo, S.A. is an online service which permits its users the search, find and reserve activities, excursions or buy products throughout the world. Ygoo, S.A. offers these products which our third-party suppliers offer to users through our website.
3 .- Reservations objective of the contract. The user can make reservations through costasur.com by internet or with our destination affiliates (management offices). Ygoo, S.A. is not proprietor of nor does it manage the travel products and services which you can access through our website.The products are the property of and are managed by and offered to the user by third-party travel suppliers, either directly or through an agency. The travel suppliers are responsible for the travel products. The reservation which you make with the suppliers will be governed by the terms and policies of privacy of the suppliers, for which it is necessary that you accept and understand the terms and policies of privacy. Your interaction with any of the suppliers which you access through our website you do at your own risk, and Ygoo, S.A. assumes no responsibility in case any problems arise with your reservation or during your trip. If you have any problems or issues with your reservation or with the product, you accept to contact the supplier to resolve the problem with them, not with us.
Making a reservation generates written proof (including emails) with a reservation number. That document initiates the contract which the client (contractee) has with Ygoo, S.A. and produces the initiation of all the rights and obligations which emanate from this contract as much for Ygoo, S.A. as for the client. Once we are aware your reservation has been paid, a confirmation of such will be sent to you.
4 .- Modification or change of reservations. All requests to modify or change reservations should be directed to the customer service team of Ygoo, S.A. which will be in charge of processing the request. Ygoo, S.A. does not charge any fee to modify or change dates of existing reservations, as long as our customer service team receives the request more than 7 days in advance of the date of travel confirmed. If you are a no-show on the date of the reserved trip or activity, you will not have the right to any refund of any kind, not partial nor full. The request for date changes or modifications will be subject to availability as provided by the suppliers of products and/or services. Ygoo, S.A. cannot guarantee that such requests will end satisfactorily.
At times, our suppliers of products and services need to make changes to dates of visit/travel or their prices, characteristics included, coverage or requirements of age, as well as other characteristics or requirements of products. As a consequence, Ygoo, S.A. reserves the right to cancel, change or substitute any service, visit, entrance fee, ticket or product which you have reserved on this website, at any moment for any reason. In these cases, if you are not satisfied with the alternatives offered, you have the right to a total refund of the original purchase price. In addition to the previous, when our agents and or suppliers of products or services inform us of a significant change to a reservation and/or visit, product or event, we will try our utmost to notify in a reasonable time period the consumer, the travel agent and /or distributor, as necessary to modify or process the reservation whenever possible.
5 .- Payments and cancellations. Ygoo, S.A. accepts the following payment methods: Mastercard, Visa, or Paypal. There are no applicable service fees nor charges for processing the payments with credit or debit cards. To make a reservation, it is essential to pay in full with a credit or debit card.
It is not possible to obtain a refund once a visit or service has commenced nor with respect to any type of package, accommodation , meals or other services used, except in accordance with its related legal rights.
Cancellation of a reservation in Ygoo, S.A. can lead to the application of cancellation charges by Ygoo, S.A., as described below. The provider or the corresponding individual tour operator may charge additional fees. When you cancel any reservation, you will be notified by email or telephone the total amount of cancellation charges, depending on provider.
You will receive a personalized voucher Ygoo, S.A. for each visit, event or service reserved by email. You must deliver the Ygoo, S.A. original and authentic voucher to the corresponding service provider to redeem for your visit, entrance ticket or package. Your reservation cannot be honored without presenting the Ygoo, S.A. valid voucher.
For security reasons, to redeem the Ygoo, S.A voucher, you must show a valid photo ID and must sign the voucher. The goal is to properly identify you and to help prevent fraud.
6 . Lawyer and Court. The relationships established in this contract are subject to the law courts and Swiss law. Any law suit brought by the client must be filed in the Courts of the town of Zug. Ygoo, S.A. can pursue legal action in the locality where the contractor is domiciled or in the Swiss town of Zug.
